In our 115-year history, the West Virginia Pharmacists Association has passed significant legislation to help shape the profession. Provider status, immunization expansion, pharmacy benefit manager regulations, and prescriptive authority happen because our pharmacists, technicians, and student pharmacists advocate for our patients and profession!

WVPA’s annual Legislative Day is the cornerstone of the association’s legislative and public policy efforts. This is an opportunity to connect with your legislator and discuss important policies impacting YOUR profession. This event allows pharmacists, pharmacy technicians, and student pharmacists to play a key role in influencing important legislation!

Shining a Light on West Virginia Pharmacy

2025: SB 526

  • prescriptive authority for influenza, SARS-COV-2, and RSV with a CLIA-waived test (test and treat)
  • refill an expired prescription for an epinephrine injection device

2024: SB 453, SB 325

  • PBM data transparency
  • prohibited drug manufacturer 340B contract pharmacy restrictions ($50,000 per violation)

2023: SB 453

  • adopted NADAC + $10.49 dispensing fee reimbursement model for WV Public Employees Insurance Agency (PEIA)

2022: HB 4112. SB 345, SB 347

  • expanded "health care payor" definition
  • required adequate notice by PBMs for contract changes
  • adoption of PBM legislative rules

2021: HB 2263, HB 4112

  • "any willing pharmacy" PBM network participation
  • drug rebate shared savings
  • defined "specialty drug" and created specialty drug review process

2020: SB 544, HB 4058, HB 3364

  • authorizes pharmacists/pharmacy interns to administer all ACIP-recommended immunizations
  • enhanced PBM penalties up to $10,000 per violation
  • expanded NADAC + $10.49 reimbursement model for commercial and ERISA plans

 

2019

  • 340B discriminatory reimbursement protections adopted
  • WV Office of Insurance Commissioner legislative rules adopted related to PBM licensure/oversight

2017/2018: SB 522, SB 46 Pharmacy Audit Integrity and Transparency Act

  • PBM registration and audit protections
  • Prohibited PBM gag clauses to inform customers of lower-cost alternative drugs
  • Full PBM licensure requirement
  • WV Medicaid implements NADAC + $10.49 reimbursement model

2016: No more Medicaid PBMs

  • WV Medicaid goes to single payor system without MCOs/PBMs.
